These are the terms and conditions of Barlin Delivery Limited ("Barlin Delivery"). These terms and conditions apply solely to customers located outside of the UK ("Customers") who purchase delivery services from Barlin Delivery on Karrimor (the "Website") and who have purchased goods from SDI (Brook EU) Limited or SDI (Brook ROW) Limited (both hereafter referred to as "Sports Direct International") on the Website.
If you place an order for delivery services, you agree to be bound by these terms and conditions. Please read these terms and conditions carefully before accessing and/or ordering any delivery services from Barlin Delivery. You should print a copy of these terms and conditions for future reference.

How the overseas delivery contract is formed between you and Barlin Delivery
Sports Direct International does not deliver goods. Barlin Delivery can provide overseas delivery for you. Customers will be offered Barlin Delivery's overseas delivery service at the delivery options page of the Website.
If you require overseas delivery please tick to accept Barlin Delivery's overseas delivery services on the delivery options page of the Website. By ticking to accept overseas delivery from Barlin Delivery you are contracting with Barlin Delivery for delivery of your goods on and subject to these terms and conditions of delivery.
Once Sports Direct International accepts your order to purchase goods (which will be confirmed to you by email), a contract to purchase the goods from Sports Direct International takes effect between you and Sports Direct International and (if you have requested Barlin Delivery's delivery service and accepted these terms and conditions), a contract to deliver the goods takes effect between you and Barlin Delivery.
The contract to deliver goods to you only relates to those goods confirmed in the confirmation email. Barlin Delivery will not be obliged to deliver any other goods which may have been part of your order until Sports Direct International makes them available for collection by Barlin Delivery at the SportsDirect.com Retail Ltd warehouse.
Barlin Delivery will not charge you for delivery until it collects the goods you have ordered from the SportsDirect.com Retail Ltd warehouse. However, upon receipt of your order, SportsDirect.com Retail Ltd (who collect your payment for Barlin Delivery's delivery service on Barlin Delivery's behalf) will create an authorisation on your account in respect of the delivery costs.
Once Barlin Delivery has collected the goods from the SportsDirect.com Retail Ltd warehouse, Barlin Delivery will assume responsibility for loss and damage risk whilst the goods are in transit until the delivery is complete.
Barlin Delivery will confirm the cost to deliver your goods overseas at the checkout but prior to acceptance of your order. The delivery cost is determined by a combination of the size, weight and value of your goods. If you decline the costs of delivery, Barlin Delivery will not provide you with delivery services. Barlin Delivery's delivery charge appears in the order summary box on the Website as "delivery".
Barlin Delivery's delivery charge will be collected by SportsDirect.com Retail Ltd on behalf of Barlin Delivery and SportsDirect.com Retail Ltd undertakes to pass your payment to Barlin Delivery on your behalf.
Barlin Delivery currently uses DHL to deliver your goods. Delivery time to overseas destinations will vary depending on where the delivery destination is. In the event that your order has not arrived within a reasonable period of time please contact customer services.
Please note that Barlin Delivery does not offer a 24 hour delivery service.
If your order is over five (5) units, Barlin Delivery will endeavour to deliver the whole order as requested, however larger orders may be delivered in separate parcels (see "Split Delivery"). This may result in a delay in the delivery of your order.
Delivery of pre-order items
Pre-ordered goods will usually be collected from the SportsDirect.com Retail Ltd warehouse by Barlin Delivery on the day before the launch date.
Barlin Delivery may split delivery of your order into several parts based on Sports Direct International's stock availability. You will not be charged extra for this facility.
Data protection and privacy
Barlin Delivery takes appropriate technical and organisational measures to protect against unauthorised or unlawful use of your personal information, including encrypting your information to applicable industry standards.
Barlin Delivery only keeps your information for as long as is necessary to process the delivery of your order.
Barlin Delivery provides your details to its couriers that deliver your orders and to Sports Direct International to administer your order.
Barlin Delivery's couriers and Sports Direct International are required to maintain the security and confidentiality of your personal details, and are required not to retain, share, store or divulge any personal information for any other purposes.
Barlin Delivery does not transfer your information outside the European Economic Area ("EEA") unless you are located outside the EEA in which case Barlin Delivery may need to transfer your information in order to deliver your goods.
When you accept Barlin Delivery's overseas delivery service you consent to Barlin Delivery processing your information in accordance with this policy and will not hold Barlin Delivery responsible for any loss of your information unless Barlin Delivery has breached its duty of care to you.
Please note your goods may be subject to import duties and taxes which will be levied when the order reaches the delivery address. You will be responsible for payment of any such import duties and taxes. Barlin Delivery has no control over these charges and cannot predict their amount. For further information please contact your local customs office before placing your order.
If your delivery is for a large quantity of goods, Barlin Delivery reserves the right to contact you and inform you of any additional shipping costs at which time you may either pay the extra amount for the delivery service or cancel your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the goods are destined. Barlin Delivery will not be liable for any breach by you of any such laws.
Barlin Delivery's contractual or tortious (including negligence) liability for losses you suffer as a result of Barlin Delivery breaking these terms and conditions is strictly limited to the cost of purchasing and delivering the goods.
This does not include or limit in any way Barlin Delivery's liability:
(a) For death or personal injury caused by Barlin Delivery's negligence;
(b) For fraud or fraudulent misrepresentation; or
(c) For any matter for which it would be illegal for Barlin Delivery to exclude, or attempt to exclude, its liability.
Barlin Delivery is not responsible for any indirect or consequential losses whether caused by tort (including negligence), breach of contract or otherwise. This clause does not affect your statutory rights.
Events outside our control
Barlin Delivery will not be liable or responsible for any failure to perform, or delay in performance of any of its obligations to you that is caused by events outside its reasonable control (a 'Force Majeure Event'). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond Barlin Delivery's reasonable control and includes (without limitation) the following:
(a) Strikes, lock-outs or other industrial action;
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
(e) Impossibility of the use of public or private telecommunications networks; or
(f) The acts, decrees, legislation, regulations or restrictions of any government.
In the event of a Force Majeure Event, Barlin Delivery's performance is deemed to be suspended for the period that the Force Majeure Event continues, and Barlin Delivery will have an extension of time for performance for the duration of that period. Barlin Delivery will use its reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which its obligations to you may be performed despite the Force Majeure Event.

Barlin Delivery's right to vary these terms and conditions
Barlin Delivery reserves the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions that are in force at the time that you order goods from the website unless:
• any change to these terms and conditions is required to be made by law or governmental authority, in which case the changes may apply to orders previously placed by you; or
• Barlin Delivery notify you of any changes (directly or via the Website) to these terms and conditions before Sports Direct International accepts your order, in which case Barlin Delivery has the right to assume that you have accepted the change to the terms and conditions unless you notify Barlin Delivery to the contrary within seven (7) working days of receipt by you of the goods.
For customers located in the EU outside of the UK, these terms and conditions shall be subject to the laws of England and the courts of England and Wales shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with this agreement.
For customers outside the EU, this agreement shall be subject to the laws of England and the courts of England and Wales shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with this agreement.
